"happening now" starts right now. jon: a fox news alert. breaking news now on the deadly terror attack on the u.s. consulate in libya. fox news sources telling us cia officers on the ground in benghazi during the attack sent requests for help but were denied. national security correspondent jennifer griffin is live at the pentagon with more on this. jennifer. >> reporter: hi, jon. well sources who were on the ground in benghazi during the attack tell fox news that in fact there were three separate requests to aid not only the attack that was occurring at the consulate and to try to help with that attack but also requests for outside help, outside military help to help once there were gunfire and firefights at the cia annex. those requests, we're told, came from higher headquarters. they were told to stand down. as you know, glen doherty and tyrone woods, the former navy seals were over at the cia annex at about 9:40 p.m. when the first shots were heard at the consulate where the ambassador and his team were taking fire. i'm told that they radioed to their higher headquart

'm jon kelley. a massive raid leads to a long list of arrests in the south bay. agents and police swarming the streets of san jose to take down a criminal network. this is a story you will see only on nbc bay area. we have the story on the raids in the newsroom. damian. >> reporter: the fbi is being tight-lipped saying the affidavits remain sealed. this is video we shot this morning at the blossom hill apartments. this is one of several locations hit. we saw agents in suits making one arrest. we understand s.w.a.t. teams lent a hand in the action. about an hour ago, the san francisco office of the fbi would say it is the lead agency and its gang task force in the south bay was in charge of the operation. >> i can't comment on the number of officers out there. there was an appropriate number of tactical personnel and fbi s.w.a.t. personnel involved in addition to numerous others across the san jose area. >> reporter: the fbi tells me the federal affidavits should be unsealed by the end of today. they will provide more details at that time. we will stay on top of this story and brin

. i'm marla tellez. >> and i'm jon kelley. we start off with a four-alarm fire at a restaurant disrupting muni service five hours. the blaze started at the squat & gobble cafe across the street from the west portal muni station. that is where christie smith has been live on the scene all day long. any idea how close things are to getting back to normal? >> reporter: we just saw a flare up a couple of minutes ago at the restaurant. firefighters are actually still spraying water on it at this hour. arson investigators haven't gotten a close look inside of the restaurant where part of the roof collapsed overnight. i think you just saw the train go by. muni is back up and running after the complete shutdown at the west portal tunnel. intense flames at west portal. that is how firefighters describe what they were up against. at 6:30 this morning, the fire was upgraded to four alarming. the squat & gobble restaurant had a partial roof collapse and it continued to spread. >> one is a wine shop and a dental office and another set of businesses. three buildings total. >> reporter:s fire

to have you along for the ride. i'm jon kelley. >> and i'm marla tellez. the question here is will he keep his job? after ten months of controversy, today is finally decision day for suspended sheriff ross mirkarimi. christie smith is live in san francisco where the board of supervisors will decide the fate of the embattled sheriff. christie, this case is about a year in the making. >> reporter: yeah, good morning to you, marla. well, this whole ordeal finally expected to come to an end after nine months of legal wrangling and a very public drama that played out here in san francisco. later this afternoon the san francisco board of supervisors expected to finally take a vote on whether or not to remove suspended san francisco sheriff ross mirkarimi from office. it would take nine votes from the 11-member board for that to happen. mirkarimi pleaded guilty after an argument with his wife. she is a tv star from venezuela. in that argument she suffered a bruised arm. mirkarimi is on probation and in counseling and the couple has reunited and said this whole thing was politically motivated. aft

pharmacy, but what the f.d.a. told us today about that pharmacy came as quite a surprise. here's dr. jon lapook. >> reporter: the food and drug administration tested 50 vials suspected to be a source of contamination in the meningitis outbreak. they found all 50 were contaminated by bacteria or fungus. the f.d.a. says internal n.e.c.c. documents show the company tested a vial from the same lot in august and labeled it sterile. the inspection also focused on the clean room at n.e.c.c. a clean room like this one is where ingredients are mixed to make sterile medication. the f.d.a. discovered n.e.c.c.'s own monitoring repeatedly found mold and bacteria growing on walls and surfaces. equipment used to sterilize medicine had "greenish-yellow discoloration" and "air ducts were dirty." according to the f.d.a., there's no evidence n.e.c.c. did anything to fix the problems. the n.e.c.c. responded today saying "we will review this report and will continue our cooperation." >> pelley: jon, thanks very much. we'll look at a key race in the battle for control of the senate. and we have the first vide

. let's bring in our traders, mike, jim, jon najarian standing by. you'retraders. when do you step in tomorrow and make your first trade? >> right with the opening prints. i think. i was watching apple trading in frankford, melissa. everybody was ringing their hands about how bad this could possibly be for apple. the way i look at it the stock was either up or down 50 cents. 50 cents after all that shakeup. after people sort of digested what was happening. being forced out. ascending to the number two spot really at apple. i think there will be great opportunities. i afree with david lutz. volumes will be lighter than normal expiration but there's a lot of pent up trading in ford, in apple. in the likes of facebook and so forth. i do think we'll actually see a fairly robust day. i don't think it will be like the day after thanks giing sort of volume. i think it will be more or less like a normal day, not a normal month end. >> michael, the other thing happening this week, we lost a couple of days in trading. for people who might have weekly options an apple is a very popular weekly

this showdown very closely with china. tech correspondent jon fortt in silicon valley looking at which companies stand to win and lose in all this. >> bob, the biggest, most obvious winner here is cisco because that's huawei's arch enemy in the networking space. cisco has accused them of stealing its source code and they've called out huawei as cisco's largest challenger. buyers and sellers themselves aren't an immediate win. public sector purchasing has been suffering and huawei didn't have a lot of share in the u.s. to begin with. but companies that do business with the government might back away from considering huawei. they're the number two telecom maker in the world so this might help cisco gain some share in other markets where governments could be influenced by the u.s. move. could also help erickson, the number one telecom commitment supplier. juniper has set up demo labs to try to push the brand. the key is what happens in europe. u.s. is just 4% of huawei's business. europe is more like 14%. that's where u.s. companies will look to gain an advantage. >> jon, china is also key to anoth

in for jon kelley. >> and i'm laura garcia-cannon. we're going to find out today if the bay area is on the short list for the super bowl. it is san francisco that's likely to win big. bob redell is live in santa clara this morning with more on what a super bowl bid means for the entire bay area. good morning, bob. >> reporter: good morning to you, laura and marla. later today the 49ers will learn if their new $1.2 billion stadium going up right behind me here in santa clara will be in the running to host super bowl mmxvi or 2017. even though the game would be held down here a lot of the partying would take place 30 miles north in san francisco where the team has been playing all this time. that means sf could take away some of the financial benefit. part of the driving force behind this, mayor ed lee of san francisco who has been working with the 49ers for putting together a bid for bringing the super bowl back to the bay area. santa clara's mayor is appreciative with ed lee taking the lead in this process. in his eyes what's good for sf is good for the region. >> great weather,
